Important Notice
This Boat Owner Agreement ("Agreement") governs your use of the YachtCare.io Platform as a Yacht Owner to post jobs, book services, and manage vessel maintenance. By registering as a Boat Owner, you agree to be bound by this Agreement.
1.Your Role as a Boat Owner
As a Boat Owner on YachtCare.io, you use the Platform to discover, hire, and pay independent Service Providers and Freelancers for marine maintenance and related services. YachtCare.io is a neutral marketplace — we facilitate the connection between you and service professionals but are not a party to any service agreement you enter.
2.Your Obligations
As a Boat Owner on the YachtCare.io Platform, you agree to:
- •Provide accurate, current, and complete information about your vessel, its location, and the scope of work required. Inaccurate information may void secure payment protections.
- •Make all service payments exclusively through the Platform's secure payment system. Off-platform payments are strictly prohibited and void all YachtCare.io protections and dispute rights.
- •Confirm or formally dispute service completion within five (5) business days of the scheduled service date. Failure to act within this period may result in the automatic release of held funds to the provider.
- •Report any service issues or disputes promptly through the Platform's messaging and dispute system.
- •Maintain adequate marine insurance for your vessel at all times, covering the vessel, its equipment, and third-party liability.
- •Treat Service Providers and Freelancers with respect and in accordance with the Acceptable Use Policy.
3.Booking and Payment Terms
Secure Payment Payment
When you book a service, your payment is captured and held in secure payment by our third-party payment processor, Stripe, Inc. Funds remain in secure payment until you confirm that the service has been completed to your satisfaction.
Platform Fee
YachtCare.io charges no platform fee to Boat Owners for standard bookings. The platform fee of nine percent (9%) is charged to the Service Provider upon completion. All fees are clearly displayed before booking confirmation.
Payment Release
Funds are released to the Service Provider only after you confirm satisfactory completion. You are encouraged to inspect all completed work thoroughly before releasing payment.
4.Cancellations and Refunds
Owner-Initiated Cancellation
If you cancel a confirmed booking more than forty-eight (48) hours before the scheduled service start time, you will receive a full refund of the held amount. Cancellations within forty-eight (48) hours of the scheduled start time may incur a cancellation fee as specified by the Service Provider at the time of booking.
Provider-Initiated Cancellation
If the Service Provider cancels a confirmed booking, you will receive a full refund of the held amount with no cancellation fee.
Rescheduling
Either party may request to reschedule a confirmed service. Any rescheduling shall only take effect upon the mutual written agreement of both parties through the Platform.
5.Dispute Resolution
All disputes arising from a service booking must be reported through the Platform within twenty-four (24) hours of the scheduled service completion. Disputes will be handled according to YachtCare.io's two-step Dispute Resolution Policy. Held funds will be held pending resolution.
Nothing in this Agreement limits your right to pursue legal action through the competent courts of the United Arab Emirates at any time.
6.Disclaimer
YACHTCARE.IO IS A MARKETPLACE INTERMEDIARY AND DOES NOT GUARANTEE THE QUALITY, SAFETY, TIMELINESS, OR LEGALITY OF ANY SERVICES OFFERED OR PERFORMED BY SERVICE PROVIDERS OR FREELANCERS. ALL SERVICES ARE PROVIDED BY INDEPENDENT THIRD PARTIES. YACHTCARE.IO IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR VESSEL OR PROPERTY CAUSED BY A SERVICE PROVIDER.
7.Governing Law
This Agreement is governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any legal proceedings shall be brought in the competent courts of Dubai, UAE.
By registering as a Boat Owner and using the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
